Golden 1 Center Community Group Ticket Acceptance Agreement

In consideration of receiving free tickets from the City of Sacramento (the “City”) to use the City’s suite (or relocated seat assignments) at the Golden 1 Center (the “City Suite”), the Organization agrees as follows: 

Organization shall not transfer, sell, auction, or raffle any of the tickets. The Organization shall distribute the tickets solely to people who work for, volunteer for, or directly benefit from the services of the Organization.

The Organization shall complete and submit to the City a list of the names of every person (with minors to be listed as "minor”) receiving a ticket. Note: The City shall provide the Organization with instructions for reporting names.

The Organization hereby releases all claims of whatever kind that may arise against the City, its officers, agents, employees, and volunteers (collectively, the “City Parties”) in any way related to the Organization’s use or distribution of tickets for the City Suite, other than claims based solely on the gross negligence or willful misconduct of any of the City Parties. This section 3 survives the termination of this agreement.

The Organization hereby assumes responsibility for the acts and omissions of every person who uses a ticket to the City Suite that was provided by the City to the Organization. The Organization shall defend and indemnify the City Parties from and against any and all actions, damages, costs, liabilities, claims, demands, losses, judgments, penalties, costs and expenses of every type and description, including any fees and/or costs reasonably incurred by the City’s staff attorneys or outside attorneys and any fees and expenses incurred in enforcing this provision (collectively, “Liabilities”), including but not limited to Liabilities arising from personal injury or death, damage to personal, real, or intellectual property, contractual or other economic damages, arising out of or in any way connected with the Organization’s use or distribution of tickets for the City Suite, whether or not (i) such Liabilities are caused in part by a party indemnified hereunder or (ii) such Liabilities are litigated, settled or reduced to judgment; provided that the foregoing indemnity does not apply to liability for any damage or expense for death or bodily injury to persons or damage to property to the extent arising from the sole negligence or willful misconduct of any of the City Parties. This section 4 survives the termination of this agreement.

This agreement exists for the entire time that an Organization is part of the Community Group Ticket Program and terminates one year after the date of the last event for which the City provided tickets to the Organization.

The person signing this agreement on behalf of the Organization represents that they are authorized to bind the Organization to the terms of this agreement.
